भारतीय न्याय संहिता 2023 मध्ये पहिल्यांदाच महिला आणि बालक  यांच्या बाबतीतील गुन्ह्यांसंबंधातील तरतुदींना प्राधान्य देऊन ते एकाच भागात आणण्यात आले आहेत. महिलांशी संबंधित गुन्ह्यांच्या प्रकरणातील दोषींना अगदी मृत्युदंडाच्या शिक्षेपर्यंत कडक शिक्षा देण्याची तरतूद करण्यात आली आहे. अठरा वर्षाखालील महिलेवरील सामूहिक बलात्कारासाठी दोषी व्यक्ती जीवित आहे तोपर्यंत जन्मठेप किंवा मृत्युदंड या शिक्षांची तरतूद आहे. लग्न, रोजगार, बढती यांची आश्वासने देऊन अथवा ओळख लपवून  शारीरिक संबंध ठेवणे या नवीन गुन्ह्याचा समावेश भारतीय न्याय संहिता 2023 मध्ये करण्यात आला आहे.

मानवी तस्करीला आणि त्या संबंधातील गुन्ह्यांना आळा घालण्यासाठी सरकार वचनबद्ध आहे. भारतीय न्याय संहिता 2023 च्या भाग 143 मध्ये मानवी तस्करीच्या गुन्ह्यासाठी अगदी जन्मठेपेपर्यंतची कडक शिक्षा देण्याच्या तरतुदी आहेत.  या गुन्ह्यामध्ये बालकांची तस्करी या गुन्ह्याचा समावेश असल्यास दोषी व्यक्तीला किमान दहा वर्षाची तुरुंगवासाची शिक्षा आहे. ही शिक्षा जन्मठेप आणि दंड इथपर्यंत वाढू शकते. मानवी तस्करीतून आणलेल्या बालकांना भीक मागायला लावणे हा गुन्हा पिळवणूक या सदराखाली असून भारतीय न्याय संहितेच्या 143 या कलमानुसार तो शिक्षेसाठी पात्र आहे.

याशिवाय भारतीय न्यायसंहिता 2023 चे कलम 144(1) अंतर्गत तस्करी झालेल्या मुलांच्या शारीरिक शोषणाबाबत अधिक कडक शिक्षेची तरतूद करते या प्रकारच्या गुन्हयासाठी किमान पाच वर्षांच्या तुरुंगवासाची असलेली शिक्षा ही जन्मठेपेपर्यंत वाढवता येऊ शकते.

PROVISIONS FOR PROTECTION OF WOMAN

1. Offences against woman and child have been given precedence over all other offences in a new chapter-V of Bharatiya Nyaya Sanhita, 2023.
2. In Bharatiya Nyaya Sanhita, the age differential for minor victims of gangrape has been done away with. Earlier different punishments were prescribed for gangrape on a girl below the age of 16 years and 12 years. This provision has been modified and now gangrape on a woman below the age of eighteen years is punishable with imprisonment of life or death.
3. Women have been recognized as an adult member of family who can receive summons on behalf of the person summoned. The earlier reference to ‘some adult male member’ has been replaced with ‘some adult member’.
4. In order to provide more protection to the victim and enforce transparency in investigation related to an offence of rape, the statement of the victim shall be recorded through audio video means by police.
5. For certain offences against woman, statement of the victim is to be recorded, as far as practicable, by a woman Magistrate and in her absence a male Magistrate in the presence of a woman to ensure sensitivity and fairness, creating a supportive environment for victims.

6. Medical practitioners are mandated to send the medical report of a victim of rape to the investigating officer within 7 days.
7. It is provided that no male person under the age of fifteen years or above the age of 60 years (65 years earlier) or a woman or a mentally or physically disabled person or a person with acute illness shall be required to attend at any place other than the place in which such male person or woman resides. In cases where such a person is willing to attend the police station, they may be allowed to do so.
8. The new laws provide for free first-aid or medical treatment to victims of crimes against women and children at all hospitals. This provision ensures immediate access to essential medical care, prioritizing the well-being and recovery of victims during challenging times.
