Implementation of FRA Claims

The Union Minister of State for Tribal Affairs Shri Durgadas Uikey today informed Lok Sabha that based on the information received from the State Governments/UT Administration, the major reasons reported for rejection of claims are - claimed land not occupied before 13th December 2005, duplicate claims filed on the same land, claims on Non-Forest Land, lack of evidence, Other Traditional Forest Dwellers (OTFD)s could not prove three generations of residence, etc. Ministry time and again has requested the State Governments that Sub-Divisional Level Committee (SDLC) and District Level Committee (DLC) may provide necessary support for providing Government documents to the claimants to support their claims.
The key grievances received in the Ministry through Centralized Public Grievance Redress and Monitoring System (CPGRAMS) portal and representations, references from individuals and civil society organizations are related to pendency of claims in states, violations of FRA, 2006, Tiger reserve related issues etc. MoTA forwards the grievances to the concerned State Government/ Union Territory Administration for appropriate action as per the provisions of the Act and the rules framed thereunder. As per FRA and rules made thereunder, implementation of the Act is responsibility of concerned State / UT The Ministry also issues advisories, clarifications and guidelines, as required, to ensure proper implementation of the Act and to address challenges faced by forest-dwelling Scheduled Tribes and other traditional forest dwellers.
Ministry of Tribal Affairs has been conducting FRA awareness campaigns from time to time; however, the year, state, district-wise details are not maintained centrally. In 2024, on the occasion of Janjatiya Gaurav Divas (15th November 2024), MoTA along with the Ministry of Panchayati Raj organized a Special Gram Sabha cum-orientation/training programme in the PESA and FRA villages for capacity building and training of elected Representatives, functionaries and other Stakeholders of Gram Panchayats/Villages identified in each State. The special Gram Sabha drive was held from 15th November 2024 to 26th November 2024. Further, State Governments have also been advised to incorporate the training on PESA and FRA as a part of state annual training calendars under Rashtriya Gram Swaraj Abhiyan (RGSA) and to conduct regular training programs on these subjects. State Government of Andhra Pradesh has informed that they have organized awareness campaigns in Parvathipuram Manyam, ASR and Polavaram districts during September 2025 to February 2026.
MoTA has approved 17 FRA cells at State-level, 324 FRA cells at District level, 90 FRA cells at Sub Divisional level based on the proposals received from the States/UT.
