The team carried out the search and seizure operation in accordance with the provisions of Sections 28 of the BIS Act, 2016.
During the inspection of the premises, BIS officials identified refrigerating appliances that were being stored without the mandatory BIS Standard Mark (ISI Mark). Eight deep freezers were found without ISI marking, without CM/L number and were seized during the operation. These products fall under the scope of the Refrigerating Appliances (Quality Control) Orders issued by the Department for Promotion of Industry and Internal Trade, under which such products cannot be stored, sold, offered for sale, or exhibited for sale without a valid BIS licence and Standard Mark.
Shri S. D. Dayanand, Scientist–F / Senior Director & Head, BIS Chennai Branch Office, stated that BIS certification through the ISI Mark is mandatory for products notified under Quality Control Orders to ensure safety, quality, and protection of consumers. He emphasized that storage or sale of such products without a valid BIS licence, or the use of fake or misleading ISI markings, constitutes a serious violation of the BIS Act, 2016 and compromises consumer safety. He further added that strict enforcement action, including seizure and prosecution, will be taken against such violations.
BIS will initiate action against the offender under the Bureau of Indian Standards Act, 2016. The offence is punishable with imprisonment up to two years or a fine not less than ₹2,00,000, which may extend up to ten times the value of the goods, or both, as per Section 29 of the Act for first contravention.
Consumers are advised to ensure that products covered under mandatory certification bear a valid ISI Mark before purchase. In case of any misuse of the ISI Mark or sale of non-certified products under mandatory certification, complaints may be lodged with BIS through the BIS Care App or by email to cnbo1@bis.gov.in. The identity of the complainant will be kept strictly confidential. Further information can be accessed on the BIS website www.bis.gov.in and through the e-BIS portal manakonline.in.
