Press Note : - Jain University, Bangalore, Declared Deemed-to-be-University by the Central Government

Whereas the Central Government is empowered under Section 3 of the University Grants Commission (UGC) Act, 1956 to declare, on the advice of the UGC, an Institution of Higher Learning as an “Institution Deemed-to-be-University”.

2.         And whereas, a proposal was received from Sri Bhagawan Mahaveer Jain Educational & Cultural Trust, Bangalore, Karnataka seeking to declare Sri Bhagawan Mahaveer Jain College, Bangalore as a ‘Deemed-to-be-University’, in the name and style of “Jain University”, under Section 3 of the UGC Act, 1956;

3.         And whereas, the UGC has examined the said proposal and vide its communication bearing F.No.26-19/2007(CPP-I/DU) dated 13.06.2008 has recommended conferment of status of ‘deemed to be university’ to Jain University, Bangalore comprising Sri Mahaveer Jain College,   Bangalore.  The UGC has also recommended that the performance of the institute may be reviewed after five years;

4.         Now, therefore, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, hereby declare that “Jain University, which is a registered Trust, shall be an “Institution Deemed-to-be-University” for the purposes of the aforesaid Act, provisionally for a period of five years, subject to the following conditions:

(i)                   Jain University’ shall comprise Sri Bhagawan Mahaveer Jain College, 91/2, Dr. A.N. Krishna Rao Road, V.V. Puram, Bangalore as its constituent teaching unit;

(ii)                 Jain University shall become an “Institution Deemed-to-be-University” with effect from the date of disaffiliation of Sri Bhagawan Mahaveer Jain College from the latter’s affiliating university, viz., Bangalore University, Bangalore;

(iii)                The declaration as made above shall cover only those academic courses / programmes of Sri Bhagawan Mahaveer Jain College, V.V. Puram, Bangalore that are presently affiliated to Bangalore University, Bangalore.

(iv)                The declaration as made above shall not extend to cover the other teaching institutions established and run by Sri Bhagawan Mahaveer Jain Educational & Cultural Trust, Bangalore, within or outside the campus of Jain University at V.V.Puram, Bangalore, including Sri Bhagawan Mahaveer Jain College, the branch located at 1st Cross, J.C. Road, Bangalore, Sri Bhagawan Mahaveer Jain College of Engineering, Jakkasandra Post, Kanakapura Taluk, Bangalore, Sri Bhagawan Mahaveer Jain Evening College and  MATS Institute of Management & Entrepreneurship, Jakkasandra Post, Kanakapura Taluk, Bangalore.

(v)                  The status of ‘deemed to be university’ conferred on ‘’Jain University”’ shall be reviewed by the UGC, through an Expert Committee, after a period of five years.

5.         The status conferred on ‘Jain University’ shall be confirmed after a period of five years on the basis of review to be conducted by the UGC through an Expert Committee and recommendation of the UGC thereof;

6.         The declaration as made in para 4 above is further subject to fulfillment / compliance of the following further conditions that:-

(i)                   The management of Sri Bhagawan Mahaveer Jain College, V V Puram, Bangalore should be legally transferred from its parent Trust, viz., Sri Bhagawan Mahaveer Jain Educational & Cultural Trust, Bangalore and vested with the Society created for the purpose of managing the Institution ‘Deemed to be University’, i.e. Jain University Trust.

(ii)                 All the movable and immovable assets and properties of Sri Bhagawan Mahaveer Jain College, V V Puram, Bangalore should be legally transferred from Sri Bhagawan Mahaveer Jain Educational & Cultural Trust, vested with the Jain University Trust and registered as such in the interest of future of students, members of faculty, employees and for maintaining the standards of higher education.

(iii)                The objectives of Jain University Trust shall confine to educational and related social and charitable activities. The Trust should not undertake or engage in any activity that is of commercial and profit-making in nature.

(iv)                There shall be no diversion of assets or funds of the Trust / ‘Institution deemed-to-be-university’ institution without prior permission of the UGC.

(v)                  Jain University Trust shall maintain a separate and distinct financial accounts in respect of its functioning as an ‘Institution Deemed-to-be-University’.

(vi)                The accounts of Jain University Trust shall be open to inspection/audit by the UGC.  Suitable provision in this respect shall also be provided for in the Memorandum of Association (MoA) / Rules of the said Trust in consultation / agreement with the UGC.

(vii)               Jain University Trust should continue to maintain the corpus fund as per the norms of the UGC. The corpus fund will be irrevocable in nature and the bank deposits maintained for this purpose should not also be liquidated or closed without prior consent of the UGC.

(viii)             As and when necessary, Jain University Trust shall update or revise or modify its MoA / Rules with the approval of the UGC. Further, specific changes/ amendments, if any, suggested by the Government of India or UGC shall also be carried out in the MoA/Rules with the approval of the UGC.

(ix)               Jain University Trust shall submit a legal undertaking to cover the issues pertaining to earmarking of assets, non-diversion of assets without prior approval of the UGC/Government of India and for providing powers/authority to the UGC to take control of assets, etc. of the ‘Jain University in the event of winding up of or dissolution of the said Institution.

(x)                 Jain University, as an ‘Institution Deemed-to-be-University’ shall award degrees in respect of the academic courses / programmes of Sri Bhagawan Mahaveer Jain College only to those students who are admitted to these courses / programmes subsequent to the date of this notification.  Accordingly, it shall make admission of students to the academic courses of Sri Bhagawan Mahaveer Jain College, under its enrolment, only with effect from the next academic year (i.e. from 2009-2010).

(xi)               The academic courses/programmes (of Sri Bhagawan Mahaveer Jain College) that are presently not affiliated to Bangalore University (affiliating university) will not fall under the ambit and purview of Jain University for the purposes of admission of students and award of degrees.

(xii)              As for the students who were already admitted to the academic programmes of Sri Bhagawan Mahaveer Jain College prior to the date of this notification, they shall continue to pursue their courses of study under enrolment and affiliation to the affiliating university concerned, viz., Bangalore University, which shall conduct examinations for them till they complete the courses/ programmes of study they are pursuing at the said College presently, and award degrees to them upon successful completion of their respective courses/programmes of study.

(xiii)            The academic courses/programmes being offered / to be offered by Jain University/ Sri Bhagawan Mahaveer Jain College will conform to the norms and standards prescribed by the relevant Statutory Councils such as the UGC, etc., as the case may be.  It shall not offer / award any degree that is not specified by the UGC. It shall also ensure that the nomenclatures of the degrees, etc. to be awarded by it are specified by the UGC under Section 22 of the UGC Act, 1956.

(xiv)             Jain University/Sri Bhagawan Mahaveer Jain College shall start new academic courses only as per the norms prescribed by the UGC.

(xv)              Jain University/ Sri Bhagawan Mahaveer Jain College shall take all the required steps to get all its eligible academic courses/programmes rated for valid accreditation by the National Assessment and Accreditation Council (NAAC), etc., as the case may be, in terms of instructions issued by the UGC vide its circular No.F.6-1(7)/2006(CPP-I) dated the 12th March, 2007. 

(xvi)             Jain University / Sri Bhagawan Mahaveer Jain College shall not conduct any distance education programmes without prior approval of UGC and Distance Education Council (DEC).  The guidelines issued by both the DEC and the UGC from time to time in the matter of imparting education through distance mode have to be complied with by it.

(xvii)           Jain University shall not start and run any study centre / extension centre / off-campus centre / off-shore campus without obtaining the requisite prior approval of the UGC / DEC / Government of India, as the case may be.  It shall open new Departments / Faculties or start new courses or include / bring other teaching institutions / Colleges, as the case may be, under its ambit/management, only as per the norms and guidelines prescribed/issued, from time to time, by the UGC/ Government of India.

(xviii)          All the prescribed norms and procedures of the relevant Statutory Councils, such as UGC, etc. and other authorities concerned in the matter of admission of students, intake capacity of students, starting of new courses/programmes, renewal of approval to the courses, etc. will continue to be in force, and shall be adhered to by Jain University/ Sri Bhagawan Mahaveer Jain College.

(xix)            The infrastructure facilities at Sri Bhagawan Mahaveer Jain College should be maintained as per the norms prescribed under the guidelines of the UGC pertaining to Deemed-to-be-Universities.

(xx)             Jain University should take immediate to steps to strengthen the research activities at Sri Bhagawan Mahaveer Jain College.  The suggestions made by the Expert Committee of the UGC in relation to need for encouraging more research activity, more sponsored projects, industry consultancy, participation in conferences and publication in good journals should be complied with.

(xxi)            The parent Trust concerned and the Jain University Trust shall abide by all the undertakings that have already been submitted to the UGC or the fresh/new undertakings it is required to submit in connection with and for the purpose of obtaining status under Section 3 of the UGC Act, 1956.

(xxii)          The observations / suggestions made by the Expert Committees of the UGC in its Inspection Report submitted to the UGC should be complied with by Jain University, so as to rectify the deficiencies and to bring about the recommended improvement at the Institute.

(xxiii)         Jain University / Sri Bhagawan Mahaveer Jain College shall abide by all the norms and guidelines as laid down by the UGC, etc. from time to time, as are applicable to institutions notified as ‘Deemed-to-be-Universities’.

(xxiv)         Jain University shall not create an impression in the mind of the general public that it has been ‘established’ under a Central Act. In order to ensure this, it shall, in all its advertisements, public notices, communications, etc., distinctly mention under its nomenclature by inserting (within brackets) a line, which shall read: “Declared as Deemed-to-be-University’ under Section 3 of the UGC Act, 1956”.
