B.S. Abdur Rahman Institute of Science & Technology, Chennai,
declared deemed-to-be-University by the Central Government
Whereas the Central Government is empowered under Section 3 of the University Grants Commission (UGC) Act, 1956 to declare, on the advice of the UGC, an Institution of Higher Learning as an “Institution Deemed-to-be-University”.
2. And whereas, a proposal was received from B.S. Abdur Rahman Crescent Engineering College, Vandalur, Chennai, Tamil Nadu seeking to be declared as a ‘Deemed-to-be-University’;
3. And whereas, the University Grants Commission (UGC) has examined the said proposal and vide its communication bearing F.No.40-5/2007(CPP-I) dated 24.10.2008 has recommended conferment of status of ‘deemed to be university’ to B.S. Abdur Rahman Crescent Engineering College, Chennai in the name of B.S. Abdur Rahman Institute of Science and Technology subject to review after five years;
4. Now, therefore, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government, on the advice of the UGC, hereby declare B.S. Abdur Rahman Crescent Engineering College, Vandalur, Chennai, Tamil Nadu, as an “Institution Deemed-to-be-University”, in the name of “B.S. Abdur Rahman Institute of Science & Technology” for the purposes of the aforesaid Act, provisionally for a period of five years, subject to the following conditions:
(i) B.S. Abdur Rahman Crescent Engineering College, Chennai shall become an “Institution Deemed-to-be-University” with the nomenclature of “B.S. Abdur Rahman Institute of Science & Technology” with effect from the date of its disaffiliation from its affiliating university, viz., Anna University, Chennai;
(ii) The declaration as made above shall cover only those academic courses / programmes of the Institution concerned (i.e. B.S. Abdur Rahman Crescent Engineering College) that are presently affiliated to the Anna University, Chennai.
(iii) B.S. Abdur Rahman Institute of Science & Technology Society shall immediately formulate / revise its Memorandum and Association (MoA) & Rules in accordance with the model MoA/Rules prescribed by the UGC and obtain approval of the UGC to the same;
(iv) The status of ‘deemed to be university’ conferred on ‘B.S. Abdur Rahman Crescent Engineering College’ shall be reviewed by the UGC, through an Expert Committee, after a period of five years.
5. The status conferred on ‘B.S. Abdur Rahman Crescent Engineering College’ shall be confirmed after a period of five years on the basis of review to be conducted by the UGC through an Expert Committee, and recommendation of the UGC thereof;
6. The declaration as made in para 4 above is further subject to fulfillment / compliance of the following further conditions that:-
(i) The management of B.S. Abdur Rahman Crescent Engineering College should be legally transferred from its parent Trust, viz., All India Islamic Foundation, Chennai and vested with the Society created for the purpose of managing the Institution ‘Deemed to be University’, i.e. B.S. Abdur Rahman Institute of Science & Technology Society.
(ii) All the movable and immovable assets and properties of B.S. Abdur Rahman Crescent Engineering College shall be legally transferred from its parent Trust, viz., All India Islamic Foundation, Chennai, vested with “B.S. Abdur Rahman Institute of Science & Technology Society” and registered as such in the interest of future of students, members of faculty, employees and for maintaining the standards of higher education.
(iii) The objectives of B.S. Abdur Rahman Institute of Science & Technology Society shall confine to educational and related social and charitable activities. The Society should not undertake or engage in any activity that is of commercial and profit-making in nature.
(iv) There shall be no diversion of assets or funds of the Society / ‘Institution deemed-to-be-university’ institution without prior permission of the UGC.
(v) The accounts of B.S. Abdur Rahman Institute of Science & Technology Society shall be open to inspection/audit by the UGC. Suitable provision in this respect shall also be provided for in the Memorandum of Association (MoA) / Rules of the said Society in consultation / agreement with the UGC.
(vi) B.S. Abdur Rahman Institute of Science & Technology Society should continue to maintain the corpus fund as per the norms of the UGC. The corpus fund will be irrevocable in nature and the bank deposit maintained for this purpose should not be liquidated or closed without prior consent of the UGC.
(vii) As and when necessary, B.S. Abdur Rahman Institute of Science & Technology Society shall update or revise or modify its MoA / Rules with the approval of the UGC. Further, specific changes/amendments, if any, suggested by the Government of India or UGC shall also be carried out in the MoA/Rules with the approval of the UGC.
(viii) B.S. Abdur Rahman Institute of Science & Technology Society shall submit a legal undertaking to the UGC to cover the issues pertaining to earmarking of assets, non-diversion of assets without prior approval of the UGC/Government of India and for providing powers/authority to the UGC to take control of assets, etc. of the ‘Institution deemed-to-be-university’ concerned in the event of winding up of or dissolution of the said Institution.
(ix) B.S. Abdur Rahman Institute of Science & Technology shall not conduct any academic courses/programmes that are not approved by the AICTE.
(x) B.S. Abdur Rahman Institute of Science & Technology, as a deemed-to-be-university, shall award degrees in respect of its approved academic courses / programmes only to those students who are admitted to these courses / programmes subsequent to the date of this notification. Accordingly, it shall make admission of students to its approved academic courses, under its enrolment, only with effect from the next academic year (i.e. from 2009-2010).
(xi) The academic courses/programmes (of B.S. Abdur Rahman Crescent Engineering College) that are presently not affiliated to the Anna University, Chennai (affiliating university) will not fall under the ambit and purview of B.S. Abdur Rahman Institute of Science & Technology for the purposes of admission of students and award of degrees.
(xii) As for the students who were already admitted to the academic programmes of B.S. Abdur Rahman Crescent Engineering College prior to the date of this notification, they shall continue to pursue their courses of study under enrolment and affiliation to the affiliating university concerned, viz., Anna University, Chennai, which shall conduct examinations for them till they complete the courses/ programmes of study they are pursuing at the said Engineering College presently, and award degrees to these students upon successful completion of their respective courses/programmes of study.
(xiii) The academic courses/programmes being offered / to be offered by B.S. Abdur Rahman Institute of Science & Technology will conform to the norms and standards prescribed by the relevant Statutory Councils such as the AICTE, UGC, etc., as the case may be. It shall not offer / award any degree that is not specified by the UGC. It shall also ensure that the nomenclatures of the degrees, etc. to be awarded by it are specified by the UGC under Section 22 of the UGC Act, 1956.
(xiv) B.S. Abdur Rahman Institute of Science & Technology shall start new academic courses only as per the norms prescribed by the AICTE and the UGC.
(xv) The declaration as made in para 4 of this notification shall not extend to cover any of the sister units of B.S. Abdur Rahman Crescent Engineering College or any of those teaching institutions which are run by the All India Islamic Foundation.
(xvi) B.S. Abdur Rahman Institute of Science & Technology shall take all the required steps to get all its eligible academic courses/programmes rated for valid accreditation by the National Board of Accreditation (NBA), National Assessment and Accreditation Council (NAAC), etc., as the case may be, in terms of instructions issued by the UGC vide its circular No.F.6-1(7)/2006(CPP-I) dated the 12th March, 2007.
(xvii) B.S. Abdur Rahman Institute of Science & Technology shall not conduct any distance education programmes without prior approval of UGC and Distance Education Council (DEC). The guidelines issued by both the DEC and the UGC from time to time in the matter of imparting education through distance mode have to be complied with by it.
(xviii) B.S. Abdur Rahman Institute of Science & Technology shall not start and run any study centre / extension centre / off-campus centre / off-shore campus without obtaining the requisite prior approval of the UGC / DEC / Government of India, as the case may be. It shall open new Departments / Faculties or start new courses or include / bring other teaching institutions / Colleges, as the case may be, under its ambit/management, only as per the norms and guidelines prescribed/issued, from time to time, by the UGC/ Government of India.
(xix) All the prescribed norms and procedures of the relevant Statutory Councils, such as UGC, AICTE, etc. and other authorities concerned in the matter of admission of students, intake capacity of students, starting of new courses/programmes, renewal of approval to the courses, etc. will continue to be in force, and shall be adhered to by B.S. Abdur Rahman Institute of Science & Technology.
(xx) The infrastructure facilities at B.S. Abdur Rahman Institute of Science & Technology should be maintained as per the norms prescribed under the guidelines of the UGC pertaining to Deemed-to-be-Universities.
(xxi) The undertakings produced to the UGC so far in connection with obtaining status of ‘Deemed to be University’ to B.S. Abdur Rahman Crescent Engineering College are given on behalf of the Parent Society. Such legal undertakings should be submitted (to the UGC) by B.S. Abdur Rahman Institute of Science & Technology Society in its name.
(xxii) B.S. Abdur Rahman Institute of Science & Technology Society shall follow and abide by all the undertakings that have already been submitted by the Parent Society to the UGC or the fresh/new undertakings it is required to submit in connection with and for the purpose of obtaining status under Section 3 of the UGC Act, 1956.
(xxiii) B.S. Abdur Rahman Institute of Science & Technology shall take all immediate steps to rectify the shortcomings/deficiencies pointed out by the Expert Committee of the AICTE in its respective Inspection Report and submit a compliance report in this respect to both the UGC and the AICTE.
(xxiv) The observations / suggestions made by the Expert Committees of both the UGC and the AICTE, in their respective Inspection Reports (submitted to the UGC), in relation facilities of Hostel facility, Computer facility, Canteen facility, Management studies, research activities, recruitment of more Ph.D degree holders as faculty, etc. should be complied with by B.S. Abdur Rahman Institute of Science & Technology, so as to rectify the deficiencies and to bring about the recommended improvement at the Institute.
(xxv) B.S. Abdur Rahman Institute of Science & Technology shall abide by all the norms and guidelines as laid down by the UGC, etc. from time to time, as are applicable to institutions notified as ‘Deemed-to-be-Universities’.
(xxvi) B.S. Abdur Rahman Institute of Science & Technology shall not create an impression in the mind of the general public that it has been ‘established’ under a Central Act. In order to ensure this, it shall, in all its advertisements, public notices, communications, etc., distinctly mention under its nomenclature by inserting (within brackets) a line, which shall read: “Declared as Deemed-to-be-University’ under Section 3 of the UGC Act, 1956”.
