Under the provision of the Right of Children to Free and Compulsory Education (RTE) Act, 2009 it is mandated that the appropriate Government has to provide free and compulsory elementary education to every child of the age 6 to 14 years in a neighborhood school, which is also applicable to the children of inter-state migrant workers.

The Ayushman Bharat Pradhan Mantri Jan Arogya Yojana (AB-PM-JAY) provides health cover of Rs.5 lakhs per family per year for secondary and tertiary care hospitalization to vulnerable families. These families include unorganized workers including migrant workers with their families as per the defined eligibility.

In order to safeguard the interest of the Migrant workers, the Parliament has enacted the Inter-State Migrant Workmen (Regulation of Employment and Conditions of Services) Act, 1979 which, inter alia, provides for registration of certain establishments employing Inter State Migrant Workers, licensing of contractors etc. Workers employed with such establishment are to be provided payment of minimum wages, journey allowance, displacement allowance, residential accommodation, medical facilities and protective clothing etc.
