The
instances of alleged violence and torture of maid servants in the National
Capital and other parts of the country have been reported.
As per data of National Crime Records
Bureau (NCRB), the total number of cases registered under different provisions
of law which come under the generic description of Human Trafficking during the
period 2010, 2011 and 2012 were 3422, 3517 and 3554 respectively. State/UT wise

There are specific legislations enacted
relating to trafficking in women and children (Immoral Traffic (Prevention)
Act, 1956, Prohibition of Child Marriage Act, 2006, Bonded Labour System
(Abolition) Act, 1976, Child Labour (Prohibition and Regulation) Act, 1986,
Transplantation of Human Organs Act, 1994, apart from specific Sections in the
IPC, e.g. Section 372 and 373 dealing with selling and buying of girls for the
purposes of prostitution.
With a view to tackle the menace of
human trafficking, Ministry of Home Affairs has undertaken a number of measures
such as:
(i) Anti –Trafficking
Nodal Cell was set up in Ministry of Home Affairs to act as a focal point for
communicating various decisions and follow up on action taken by the State
Governments. All the States / Union Territory Administrations have nominated
Anti Trafficking Nodal Officers who coordinate amount themselves in inter-state
trafficking cases.
(ii) Advisories have
been issued from time to time to States / Union Territory Administrations for
preventing and combating crime of human trafficking.
(iii) The Bureau of Police Research and
Development (BPR&D) has prepared a training manual on “Human
Trafficking-Handbook for Investigators” for sensitizing police personnel and
these handbooks are being used in the National, Regional and State Police Training
Institutes.
In
order to safeguard the interest of job seekers, Ministry of Labour &
Employment has issued guidelines on 30.10.2013 to the State Governments and
Union Territory (UT) Administrations to consider regulation of the functioning
of Private Placement Agencies. States & UTs have been asked in October
2013 to register placement agencies providing domestic workers specifically
under Shops & Establishments Act.
